1. Overview

These Terms of Service ("Terms") govern your access to and use of The Punisher website, the associated customer portal, and the desktop application (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

2. Accounts & Authentication

You may need to create an account and authenticate using supported identity providers (for example, Microsoft Azure AD). You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account.

By creating an account, you consent to receive email communications from The Punisher, including service announcements, product updates, promotional offers, and newsletters. You may unsubscribe from non-essential marketing emails at any time via the link provided in each email or by contacting [email protected]. Essential service-related communications (e.g., billing, security, and account notifications) cannot be opted out of.

3. Desktop Application

The desktop application is provided for Windows (MSI installer) and macOS (PKG installer). You agree to install and use the desktop application only on devices you own or are authorized to administer.

• Figma access: the app may access design files via the Figma API only with your explicit consent.
• Browser capture: the app may capture Microsoft Edge or Safari sessions only with your explicit consent and only for the purpose of performing visual comparison.

4. Plans & Usage Limits

The Service is offered under multiple plans:

• Free: up to 2 executions.
• Basic: up to 100 executions.
• Unlimited: unlimited executions.

An "execution" refers to running a comparison job (design extraction, capture, comparison, and report generation). We may update plan details from time to time.

5. Payments, Billing Portal & Cancellation

Payments are processed via Stripe. You may create, manage, or cancel your subscription through the Stripe Checkout and Stripe Billing Portal flows available in the Service.

6. Refunds

All payments are non-refundable. You may cancel anytime; access continues until the end of the billing period.

7. Acceptable Use

You agree not to misuse the Service, attempt to gain unauthorized access, or interfere with the normal operation of the Service. Please review our Acceptable Use Policy for additional requirements.

8. Security

We implement reasonable administrative, technical, and organizational measures to protect the Service. However, no system is perfectly secure. You agree to promptly notify us of any suspected unauthorized access.

9. Disclaimers

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the maximum extent permitted by law, The Punisher will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

Total liability is capped at the fees paid (or payable) by the customer in the 12 months preceding the event giving rise to the claim.

11. Governing Law & Compliance

These Terms are intended to comply with applicable Spanish, European Union, and United States laws where the Service is offered. If you access the Service from outside Spain, you are responsible for compliance with local laws.
